Our litigation attorneys have experience representing a wide variety of clients on matters concerning intellectual property and in negotiating resolution of disputes prior to litigation. The firm's intellectual property litigation practice currently centers on providing Delaware counsel to firms involved in legally and technically complex patent litigation pending in the District of Delaware. The District of Delaware is one of the busiest venues for patent litigation in the United States. Our attorneys have experienced multiple bench trials and jury trials with each of the Court's judges, and have participated in numerous mediations with the Court's Magistrate Judge (who is used primarily for settlement conferences). Our attorneys and our staff are familiar with the role of local counsel and have the flexibility to meet its constantly changing demands. In addition, attorneys in this department have actively litigated cases alleging unfair competition, breach of employment/confidentiality agreements, and theft/misuse of trade secrets.
The firm's intellectual property transactional practice involves advising clients regarding the various issues related to intellectual property protection. Our practice in this area includes counseling clients on the selection, protection and enforcement of trademarks as well as securing trademark protection. We provide advice as to trademark, copyright and domain name matters, and we assist our clients in preparing and prosecuting state and federal trademark applications and other documents necessary to maintain trademark registrations. While we do not prosecute patent applications in the U.S. Patent and Trademark Office, we have established relationships with excellent firms that have that capability. Attorneys in this department also have experience drafting software and trademark licenses.
